Abstract:

الحمد لله رب العالمين والصلاة والسلام على أشرف المرسلين ، سيدنا محمد صلى الله عليه وسلم وبعد : لقد تناولت هذه الدراسة موضوع: (حقوق الإنسان في الدعوى الجنائية) ، وتكمن أهمية الدراسة في إظهار وتبيان حقوق الإنسان في مجريات الدعوى الجنائية، وحرص المشرع على ضمان وحماية هذه الحقوق ، وهذا الموضوع لم يتم التطرق له بشكل كاف ، كما أردت أن أثرى المكتبة القانونية بمؤلف يجمع شتات هذا الموضوع وأحكامه بأسلوب سهل وميسور ، مع معالجته من جميع جوانبه . وقد قسمت موضوع الدراسة إلى أربعة مباحث: تناولت في المبحث الأول : تعريف حقوق الإنسان في الدعوى الجنائية . وفى المبحث الثاني : حقوق الإنسان بين الفرد والدولة . وفى المبحث الثالث : الدعوى الجنائية . والمبحث الرابع والأخير: حقوق المتهم والمحكوم عليه والشهود في الدعوى الجنائية. وثم ختمت الدراسة بالنتائج ، ومن أهمها: • إن الإنسان له حقوق في مجريات الدعوى الجنائية ، سواء كان متهماً ، أو شاكياً ، أو عند توقيع عقوبة عليه ، وتلك الحقوق أقرها المشرع ونصت عليها كافة النظم القضائية والمعاهدات والمواثيق الدولية . وعلى ضوء النتائج كانت هنالك بعض التوصيات ، منها: • في مجريات الدعوى الجنائية نوصي الجهات المختصة أن تمنح الفرد الضمانات الكافية من أجل الدفاع عن نفسه وإثبات براءته وذلك حتى لا يدان وهو بريء.

Thtte Praise to Allah, lord of the Worlds, and prayers and peace is upon the most merciful, our master Mohammed peace id upon him, and after: This study, search with the subject of (Human rights in the criminal litigation). The importance of the study is to show and demonstrate human rights in the proceeding of criminal litigation. The legislator is keen to guarantee and protect these rights. This topic has not sufficiently addressed. The author brings together this issue and its rulings in an easy and accessible manner, with its treatment in all its aspects. The study divided into four sections: - The first section included; the definition of human rights in criminal litigation. - The second section included; human rights between the individual and the state. - The third section included; criminal litigation. - The fourth and last section included; the rights of the accused convicted and witnesses in criminal litigation. Then concluded the study results and the most important; - A person has rights in the proceedings of the criminal litigation, whether he is accused or witnesses, or when a penalty is imposed on him, these rights were approved by the legislator and stipulated by all judicial systems, treaties and international agreements. Finally, there were some recommendations, including: - In the proceeding of the criminal litigation, the individual must give sufficient guarantees in order to defend himself and prove his innocence so as not to be
