Abstract:

تناول هذا البحث آثار المتغيرات الدولية على آليات تنفيذ القانون الدولى بهدف بيان دور العولمة والإرهاب العالمي على اليات تنفيذ القانون الدولى الانسانى، لأجل الإسهام في تقديم دراسة متخصصة تبحث الجوانب المختلفة المتغيرات الدولية فى مجال القانون الدولى، وتكمن مشكلة البحث في معرفة ماهية الآثار المترتبة على انتهاك قواعد القانون الدولي الإنساني، ودور الأحادية القطبية على النظام العالمي، ولدراسة اشكالية إتبع الباحث المنهج الوصفي التحليلي مع المنهج الوثائقى التاريخي بجمع المعلومات من الاتفاقيات والكتب والوثائق والدراسات وتحليلها، وقسم البحث الى ثلاثة فصول الأول مفهوم المتغيرات الدولية، والفصل الثانى أليات تنفيذ القانون الدولى الانسانى، الفصل الثالث آثار المتغيرات الدولية على آليات تنفيذ القانون الدولى الانسانى، ومن أهم النتائج التى توصلت اليها ان الغرب لا يسعى لنشر قيمه الاجتماعية عبر العولمة فحسب رغم عدم الاقتناع الواسع بها كقيم، بل إنه يفرضها عبر المؤتمرات الدولية والضغط على الدول التي لا تستجيب، وأخطر انتهاكات حقوق الإنسان والحريات الأساسية، غالبا ما يتم تبريرها من قبل الحكومات على أنها ضرورية لحماية الأمن القومي، والولايات المتحدة تنظر بعين الإعتبار أن الحرب على الإرهابيين، هي حرب على الإسلام والذي إرتبط رسمياً بعد أحداث سبتمبر بتنظيم القاعدة في أفغانستان، يوصي الباحث بإلغاء المادة (124) من النظام الأساسي للمحكمة الجنائية الدولية، الذي يتيح للدول إعلان عدم قبولها اختصاص المحكمة على جرائم الحرب المرتكبة من قبل مواطنيها لمدة سبع سنوات، والعمل على تحجيم دور مجلس الأمن في علاقته بالمحكمة الجنائية الدولية، حتى لا تطغى الاعتبارات السياسية على عمل المحكمة .

This research deals with the effects of international variables on the implementation mechanisms of international law with the aim of explaining the role of globalization and global terrorism on the mechanisms of implementing international humanitarian law, in order to contribute to presenting a specialized study that examines the various aspects of international variables in the field of international law, and the problem of the research lies in knowing what are the implications of violating the The rules of international humanitarian law, and the role of unipolarity on the global system, and to study the problematic, the researcher followed the descriptive and analytical approach with the historical documentary approach by collecting information from conventions, books, documents and studies and analyzing them. The third chapter, the effects of international changes on the implementation mechanisms of international humanitarian law, and one of the most important findings that I have reached is that the West not only seeks to spread its social values through globalization, despite the widespread lack of conviction in them as values, but rather imposes them through international conferences and puts pressure on countries that do not respond, and the most serious violations Human rights and fundamental freedoms are often justified by governments as necessary In order to protect national security, and the United States considers that the war on terrorists is a war on Islam, which was formally associated after the September events with Al-Qaeda in Afghanistan, the researcher recommends abolishing Article 124 of the Statute of the International Criminal Court, which allows states to declare their non-acceptance The court's jurisdiction over war crimes committed by its citizens for a period of seven years, and work to limit the role of the Security Council in its relationship with the International Criminal Court, so that political considerations do not overwhelm the work of the court.
