Abstract:

هدف هذا البحث لتناول أحكام حوادث الطائرات والتعويض عن الاضرار التي تقع من خلالها وتوضيح الآثار الشرعية المترتبة على حوادث الطائرات والتعويض عنها، والوقوف على حوادث الطائرات والتحقيق فيها بالسودان، وتكمن أهمية البحث فى ان إحصائيات حوادث الطائرات بيّنت كثرة هذه الحوادث بأنواعِها المختلفة، وما يترتب على ذلك مِن نتائِجَ عظيمة وخطيرة، وحاجة الناس الماسّة لمعرفة الأحكام المتعلقة بحوادث الطائرات؛ لِما فيها مِن حفظٍ للحقوق، وصيانتِها مِن الضياع ، وتبرز مشكلة البحث من خلال التساؤل الرئيس التالي: ما هى أحكام حوادث الطائرات والتعويض عن الاضرار التي تقع من خلالها؟، إتبع الباحث المنهج التاريخي الاستردادي الوثائقي ثم المنهج الوصفي التحليلي، من اهم النتائج التى توصلت اليها تتوزع أحكام الطائرات وما يترتب عليها بين القانون الدولى العام والخاص، ومن التوصيات تشديد الرقابة على مالكى ومشغلى الطائرات بضرورة الإلتزام بإجراءات الأمن والسلامة، قصر حالات إعفاء مالكى ومشغلى الطائرات من المسؤلية عن الحوادث فقط فى حالات الظروف القاهرة والحوادث الفجائية، وإيلاء جانب التدريب اهتماماً أكبر فى مجال التحقيق فى الكوارث الجوية، والسعى لإنشاء معمل بدائرة المختبرات الجنائية يختص بإسترجاع وتحليل بيانات الصندوق الأسود.

This research came under the title of “Aircraft Accident Rulings and Compensation for Damages Caused by It” with the aim of clarifying the legal effects of aircraft accidents and compensating for them, as well as investigating and investigating aircraft accidents in Sudan. The consequence of this is great and dangerous results, and the people's urgent need to know the provisions related to aircraft accidents, because of the protection of rights and their maintenance of loss, and the research problem arises through the following main question: What are the provisions of aircraft accidents. The researcher followed the historical documentary retrieval approach, among the most important results of the aircraft use relationships and their consequences are distributed between the public and private law so it is difficult to address them In one specialty, although they were among the recent issues that the jurists did not address in the past, but they are often not devoid of the means Conventional transportation from docks and ships, and among the recommendations is to tighten oversight of aircraft owners and operators with the need to adhere to security and safety procedures, limit cases of aircraft owners and operators exempt from liability for accidents only in cases of force majeure and sudden accidents, and pay more attention to the training aspect In the field of air disaster investigation, and the endeavor to establish a laboratory in the Department of Criminal Laboratories for the retrieval and analysis of black box data.
