dc.description.abstract	هدفت الدراسة إلى بيان الآتي: العقد الالكتروني هو اتفاق يتلاقى فيه الإيجاب بالقبول على شبكة دولية مفتوحة للاتصال عن بعد، وذلك بوسيلة مسموعة مرئية بفضل التفاعل بين الموجب والقابل. العقد الالكتروني ينتمي إلى زمرة العقود التي اصطلح القانونيون على تسميتها (العقود التي تبرم عن بعد وذلك بوسائل الاتصالات الحديثة). ولتحقيق أهداف البحث اتبع الباحثان في هذا البحث المنهج العلمي التاريخي الوثائقي بالرجوع إلي المراجع والمصادر المتعلقة بالمادة وما تقتضيه خطة البحث ثم الوصف التحليلي بشرح المادة شرحا دقيقا. من خلال هذا البحث فقد توصل الباحثان إلي عدة نتائج وتوصيات منها. - أن جهاز الهاتف يقوم بنقل الكلام بين المتحدثين بدقة متناهية وعليه فإن العقد فيه لا يختلف عن العقد بين الحاضرين إلا من حيث البعد المكاني بين المتعاقدين. - التلفون"، اللاسلكي، الراديو، التلفزيون، وأشرطة التسجيل الناقلة للأصوات فقط أو للصوت والصورة تعد من الوسائل الحديثة التي يمكن إبرام العقد بها. - نوصي المشرع السوداني علي نص قواعد قانونية تنظم أحكام الأجهزة الحديثة كوسيلة من وسائل إبرام العقود الالكترونية لأهميتها.	en_US
