| dc.description | The study aims to introduce the role of the International Court of Justice (ICJ) in settling the African conflicts within introducing (ICJ) in term of the formation of the court and the procedures followed to bring suit and pleading before it and the rules which the court applies to determine the conflict. The study showed the amendments which are inserted in the court regulation in the items related to the formation of special circles and the number of its judges and how they are selected.Thus the trustiness of African States in the court increased. The also shows some of the African conflicts which are brought to the court. The following are the results of the study:The competence of the court in settling the African legal conflicts through special circles.2.The success of the court in settling African conflicts submitted to it.Finally the recommendations:1.To advice the African States to settle their legal conflicts through the court. 2.The African countries must qualify jurists in the field of settlement of the International conflicts. | en_US |
| dc.description.abstract | ركزت الدراسة على التعريف بدور محكمة العدل الدولية فى تسوية المنازعات الأفريقية من خلال التعريف بالمحكمة من حيث كيفية تشكيل المحكمة والاجراءات المتبعة فى رفع الدعوى والمرافعة أمامها , والقواعد التى تطبقها المحكمة للفصل في النزاع, كما أوضحت الدراسة التعديلات التى أدخلت على لائحة المحكمة فى المواد المتعلقة بتشكيل الدوائر الخاصة وعدد قضاتها وكيفية اختيارهم, الامر الذى تسبب فى زيادة ثقة الدول الأفريقية بالمحكمة وإقبالهم عليها, كما قامت الدراسة بعرض بعض المنازعات الأفريقية التي رفعت للمحكمة, ومن ثم خلصت الدراسة الى العديد من النتائج والتي من ضمها 1 - صلاحية المحكمة للفصل فى المنازاعات القانونية الافريقية عبر الدوائر الخاصة. 2- نجاح المحكمة فى الفصل فى المنازعات الأفريقية التي عرضت عليها. ومن ضمن التوصيات التي خرجت بها الدراسة 1 - حس الدول الأفريقية بتسوية منازعاتها القانونية عن طريق المحكمة. 2- أن تعمل الدول الأفريقية على تأهيل قانونيين فى مجال تسوية المنازعات الدولية. | en_US |
