dc.description	The study aims at investigating the modern methods of the execution of capital punishment and death penalty . The study consists of an introduction which includes the study reasons, aims, significance, limitations, problems, hypotheses and methodology. The study includes two sections. The first section discusses the attitude of Islamic jurisprudence in the implementation of retribution by sword and the cause of the differences, the opinions of scholars and their evidences. Section two explains the more correct opinion and the controls of using the modern machines in capital punishment and death penalty . The study has come to a number of results . The most important of them are the acceptance of Islamic jurisprudence to the modern means of the implementation of retribution and death penalty , aswell as the prohibition of violation of human dignity and torture in Islam	en_US
dc.description.abstract	تهدف الدراسة إلى بحث الوسائل الحديثة في تنفيذ عقوبتي القصاص والإعدام واحتوت هذه الدراسة على مقدمة بدورها احتوت على أسباب وأهداف وأهمية الموضوع وحدود البحث ومشكلاته وفرضياته والمنهج المستخدم في كتابة البحث كما احتوى البحث على مبحثين ، المبحث الأول تحدثت فيه عن موقف الفقه الإسلامي في تنفيذ القصاص بالسيف و سبب الاختلاف وأراء الفقهاء وأدلتهم المبحث الثاني: الرأي الراجح وضوابط استخدام آلات القصاص والإعدام الحديثة وموقف الشرع منها: توصلت الدراسة إلى عدد من النتائج أهمها قبول الفقه الإسلامي للوسائل الحديثة في تنفيذ عقوبتي القصاص والإعدام , فضلاً عن تحريم الإسلام لانتهاك كرامة الإنسان وتعذيبه .	en_US
