Abstract:
Description:
Arbitration is regarded as one of the most important alternative methods of dispute resolution due to its speed, flexibility, and confidentiality compared with ordinary litigation. These advantages have led to its growing importance in both domestic and international civil and commercial transactions. Consequently, arbitration has gained widespread recognition as an effective mechanism for achieving justice, resolving disputes efficiently, and preserving the stability of legal and commercial relationships.
The arbitral award represents the final outcome of the arbitration process and the primary objective sought by the disputing parties. Once issued in accordance with the applicable legal requirements, it becomes binding upon the parties and acquires the authority of res judicata, thereby preventing the same dispute from being litigated again, provided that the legal conditions for such authority are satisfied. However, the binding nature of an arbitral award does not eliminate the role of the judiciary. Courts continue to exercise limited judicial supervision to ensure compliance with the law, the validity of the arbitration proceedings, the protection of the parties' rights, and the consistency of the award with public policy, without interfering with the merits of the dispute or undermining the independence of arbitration.
The significance of studying the authority of arbitral awards and judicial supervision lies in achieving a proper balance between the independence of arbitration and the necessity of judicial oversight to safeguard procedural fairness and strengthen confidence in the arbitration system. This topic has become increasingly important in light of the continuous development of national arbitration laws and international conventions, as well as the expanding use of arbitration in resolving commercial and investment disputes.
Accordingly, this study aims to examine the legal basis of the authority of arbitral awards, analyze the scope and legal effects of such authority, explore the limits of judicial supervision over arbitral awards, and evaluate the extent to which legislation, judicial practice, and legal scholarship have succeeded in balancing the autonomy of arbitration with the protection of rights and the achievement of justice.
