Abstract:
يتناول هذا البحث والذي هو بعنوان: مظاهر مسؤلية الطبيب الجنائية وتطبيقاتها القضائية، الأحكام القانونية للمسؤولية الجنائية للطبيب والتى وضعت لممارسة الطب، وتشير إلى التقدُّم العلمي والتقني في العصر الحديث، وتلقي الضوء على مسؤولية الطبيب، مع التفريق بينها وبين والمضاعفات التي قد تحدث نتيجة للتدخُّل العلاجي، وكانت أهمية الموضوع تأتى من شرف وكرامة متعلقه وهو النفس الانسانية حيث تظهر آثار هذا الخطأ فى نفس بشرية كرمها الله وشرفها، وقد اتبعت فى هذا البحث المنهج الاستقرائي التحليلي والمقارن حيث أنه منهج يقوم على جمع موضوعات البحث من مصادرها وتحليلها ومن ثم مقارنتها لإستخلاص النتائج والتوصيات، من أهم نتائج البحث أن مسؤولية الطبيب الجنائية لا تعني أن يؤاخذ بالظن والاحتمال، لأن المسؤولية تترتَّب على خطأ ثابت محقَّق لا جدال فيه، ومن أهم التوصيات تطوير وتحديث اعاده صياغه القوانين والتشريعات الموجودة لتواكب المستجدات الطبية والمجتمعية؛ مثل قانون الصحة العامة لعام 1975، وقانون نقل الاعضاء والانسجة البشرية لعام 1978م.

This study, entitled: Legal Responsibility for Medical Errors, discusses the legal provisions for responsibility for medical errors which have been developed for the practice of medicine, refers to scientific and technical progress in modern times, and sheds light on the responsibility of the doctor, while distinguishing between them from medical error and complications that may occur as a result of intervention And the importance of the subject comes from the honor and dignity related to the human soul where the effects of this error appear in the same human dignity and honor of God, has been followed in this research method inductive analytical and comparative as it is based on the collection of research topics from sources and analysis And then compare them to draw conclusions and recommendations , The main results of the research:Medical errors in their content affect the safety of patients. The doctor is liable when he violates his professional obligations. The error is not required to be serious or simple. Investigator is indisputable, The most important recommendations are:The study recommends teaching the ethics and jurisprudence of doctors in medical schools in the Islamic world, and rooting the meaning of self-monitoring in medical curricula and practices.
