Abstract:
يهدف هذا البحث الى بيان أثر القوة القاهرة على عقود الإنشاءات الدولية (فيديك) وإيجاد الحلول القانونية للمشاكل التي تطرأ علي تنفيذها فى حالة تعثر تنفيذ العقد بسبب قوة قاهرة، وتظهر أهمية هذا البحث فى تناوله للحماية القانونية والاتفاقية التى أصبغتها نماذج الفيديك على أطراف عقود الإنشاءات الدولية، ومن هنا تظهر مشكلة البحث وتتبلور فى الإجابة على السؤال الرئيس الذي يثار وهو: ما هي آثار القوة القاهرة علي عقود الفيديك ؟ وقد إتبع الباحث المنهج التاريخي الوثائقي بالرجوع الي المراجع المتعلقة بالمادة ثم المنهج الوصفي التحليلي، من نتائج البحث الهدف الأساسي لفيديك هو دراسة جميع مشاكل المهندسين الأعضاء والتي تخص حمايتهم وتطويرهم دون إعتبار للإتجاهات السياسية أو الدينية أو العرقية، ومن التوصيات على المهندسين الوطنيين العمل على زيادة نمو الصناعات الهندسية الإستشارية لتكون عالمية وفعالة .

This research aims at showing the effect of force majeure on international construction contracts (FIDIC) and finding legal solutions to the problems that may arise in the implementation of the contract due to force majeure. The importance of this research in dealing with legal protection and the agreement adopted by FIDIC models on the parties to international construction contracts , Hence the problem of research and crystallize in answer to the main question is raised: What are the effects of force majeure on FIDIC contracts? The researcher followed the documentary historical approach by reference to the references on the article and the analytical descriptive approach. The main objective of FIDIC is to study all the problems of the member engineers that concern their protection and development without considering the political, religious or ethnic trends. Consulting engineering industries to be global and effective.
