Abstract:

يهدف البحث البحث في مدى إلمام الفقهاء بالموضوعات المتعلقة بالمقدسات الدينية ، سواء من حيث وضع ضمانات تكفل حسن حمايتها ، أو وضع القيود التي تضمن عدم المساس بها ، والاضطلاع على ما توصل اليه القانون الوضعي في هذا المجال مقارنة بالفقه الاسلامي. تناول هذا البحث (حماية الاماكن العبادة والمقدسة من الاعتداء في الفقه والقانون الدولي الانساني) المنهج الذى اتبع فى هذا البحث هو المنهج العلمى الوثائقى المتكامل والمنهج الاستقرائى بعرض المادة وما يقتضيه خطة البحث وتعريفها ثم الوصف التحليلى والتعليق , ولقد جاء هذا البحث في أربعة فصول : الفصل الاول : ماهية حماية والاماكن العبادة والمقدسة والمعايير المعتمدة لتصنيفها وقد لجأت إلي الفصل الثاني :موقوف الديانات السماوية مع بعضها ثم لجأت إلي الفصل الثالث وتحدثت فيه عن حماية المقدسات الدينية في القانون الدولي والفصل الرابع: جرائم الاعتداء على اماكن العبادة والمقدسات وقد توصلت إلي عدة نتائج وتوصيات وأهمها: -أ ن الأماكن الدينية المقدسة هي تلك الأماكن المعتبرة من قبل الأديان السماوية الثلاثة التي تؤمن بعقيدة التوحيد. - أن حماية المقدسات الدينية التي تشكل القيم الروحية للشعوب لا تقل أهميتها عن حماية الكيان المادي للإنسان. ومن التوصيات: - نوصي المشرع الوطني بتشديد العقوبات على مرتكبي جرائم الاعتداء على الاماكن المقدسة
