the research which titled environment protection mechanism in Sudanese and international laws aimed to study and identify the concepts of environment protection in the international and Sudanese legal thoughts, and specify the ability to apply it in local environment, suggesting some executive procedures to solve the practice obstacles and recover the legal loopholes in the laws in force . The research divided in to four chapters , the first chapter the economical pollution , the second chapter the mechanism and international covenant to protect environment , the third chapter suggested model philosophy , forth chapter application study . he research problem presented in the following questions, "What is the legal mechanism and means that adopted by Sudanese legislature for environment protection, what is the role of the judges in applying, what is the legal loophole in the local mechanism in comparison with the international obligations of Sudan, what is the suggestion that develop the local standing mechanism to satisfy the international obligations of Sudan . The study followed the historical and descriptive and analytical methods, the statistical and analytical method.
The most important finding of the study that the Sudanese laws in force dose not classify the establishments in relation to exposing impact of the environment pollution, the weakness of the prescribed penalties in the Sudanese laws to achieve the deterrence, The functions of the Supreme Council for the Environment do not include assisting the victims of pollution of the environment by the necessary legal means. The most important recommendations are: The importance of the Sudanese law to include the bases and schedules of classification of enterprises according to the degree of exposure of the environment to the pollution resulting from them, the tightening of the penalties prescribed in Sudanese law to achieve the main objective of which is deterrence. The Supreme Council of Environment should help the victims of pollution of the environment by the necessary legal means. |
