Abstract:

من المعلومفي الدين الاسلامي جعل حفظ المال من أحد الضروريات الخمس ومنع نزع ملكية العقار الا للمصلحة العامة، تطبيقاً لقواعد الشريعة والقانون جائزلرعاية المصالح وتنزيل الحاجة العامة منزلة الضرورة وتحمل الضرر الخاص لتفادي الضرر العام, ويحتوي البحث على ثلاثة فصول ومقدمة وخاتمة ،وتوصل الباحث الى عدة نتائج وتوصيات منها. ترجع أهميته موضوع نزع الملكية للمنفعة العامة إلى اعتبارين أحدهما قانوني والآخر عملي: فالاعتبار القانوني يكمن في أن الملكية الخاصة مستقرة ومحمية قانونًا وبالتالي فإن المساس بها يعد استثناء يجب على الإدارة أن لا تتعسف فيه ولا تنحرف بسلطتها إزاءه، وبناء على ذلك فإن نزع الملكية يقوم على تعارض بين المصلحة العامة والمصلحة الخاصة وعند التعارض يتم تغليب المصلحة العامة اتبع الباحث المنهج العلمىالوثائقى التاريخي حيث تم عرض المادة وما تقتضيه خطة البحث وتعريفاتها ثم المنهج الوصف التحليلى اولا: من النتائج البحث: 1. لا يتم نزع الملكية إلا في إطار القانون، ويترتب عليه تعويض فانوني عادل ثانيا : من التوصيات البحث 1. على المشروع تنظيم قوانين ولوائح في إطار نزع الملكية العقارية الخاصة لمصلحة العامة
