Abstract:
من خلال الدراسة إلى توضيح أهمية الحيازة كسبب من أسباب كسب الملكية وتطرقت إلى اختلاف الآراء حول الحيازة هل هى حق أم سبب لكسب الملكية وبين آراء القائلين بأنها حق من الحقوق العينية وقد تعرضت للنقد حيث أن وجه النقد يتلخص في أن الحيازة ليست حقاً عينياً لأن أساس الحقوق العينية هو حق الملكية ومنه تتفرع سائر الحقوق وهي سبب مستقل من أسباب كسب الملكية كذلك وضحت تعريف الحيازة في الفقه والقانون وماهيتها وشروطها.
توصلت من خلال البحث الاستقراء أن الحيازة سبب من أسباب كسب الملكية ، حسب أراء الفقهاء والقانونيين ، والتطبيقات القضائية .
وأخيراً وضعت خاتمة أوضحت فيها عناصر البحث واهم النتائج والتوصيات التى توصلت لها وهي كالأتى :
النتائج :
1. أن الحيازة تكسب الملك .
2. أن الحيازة حق للحائز .
3. أن الحيازة تثبت بالمدة التي يجوز فيها الحائز على الأرض .
Description:
The aim of this research is to give an illustration of the importance of tendril as one factor of ownership . in addition I mentioned the different opinions of ten rail whether it is a right or just a factor for acquiring ownership and the opinions of those who say tenurial is a right of the in kind however it is critized because of the aspects of he critism which say the tenurial is not an in kind for the fact that the basis of the in kind is the ownership right from which divided the other rights and it is an independent factor of those of acquiring ownership .
Later the study shows the definition of tenurial as a concept of law and legislation with its essence and conditions through the study and induction I found that tenurial is one factor of acquiring ownership according to the opinions of jurists and legists and judiciary application .
Finality I write the conclusion of the research which contains the elements of the research and the important results and comments as shown below :
1. Tenurial can Aguirre the ownership .
2. Tenurial in a right to its owner .
3. Tenurial proved by the period needed for possessing the land comments :
1. the Sudanese's legitimizer should illustrate special code act for – for tenurial .
2. the owner should continue his ownership safely so that he may not lose his right for ownership .
