dc.description	This research is entitled "The provisions of the missing and absent in jurisprudence and law". The research deals with the concept of missing and missing, and the provisions related to the wife of the missing and her imprisonment and the provisions of her money and the appearance of death or life, because of the importance of this subject in the lives of real people, The provisions relating to a large segment of people in this age, which spread the phenomenon of migration and travel to work or study, and the outbreak of wars and the outbreak of internal and external strife, and the aim of collecting the provisions of the absent and missing to facilitate those who wanted to refer to those provisions, In this research, the historical approach was followed with the analytical descriptive approach to reach the results of the research. If the missing person returned, Among the recommendations I recommend every Muslim to write his will, especially when it is on the travel of the Prophet Muhammad peace be upon him.	en_US
dc.description.abstract	جاء هذا البحث بعنوان " أحكام المفقود والغائب فى الفقه والقانون " وقد تناول البحث مفهوم المفقود والغائب ، ثم الأحكام المتعلقة بزوجة المفقود وتربصها وأحكام أمواله وظهور حاله من موت أو حياة ، وذلك لأهمية هذا الموضوع في حياة الناس الواقعية ، فإن عامتهم في حاجة إلى معرفة هذه الأحكام المتعلقة بشريحة كبيرة من النـاس في هذا العصر الذي انتشرت فيه ظاهرة الهجرة والسفر للعمل أو الدراسة، وكثر فيه نشوب الحروب واندلاع الفتن الداخلية والخارجية ، وبهدف جمع أحكام الغائب والمفقود تسهيلاً لمن أراد الرجوع إلى تلك الأحكام، وقد اتبعت فى هذا البحث المنهج التاريخي مع المنهج الوصفى التحليلي للوصول إلى نتائج البحث، من نتائج البحث إذا عاد المفقود وقد تزوجت امرأته وحملت وخُيِّرَ المفقود بينها وبين صداقها فاختارها فإنها تعود إليه بعقده الأول ولا يقربها حتى تضع حملها، وتطهر من نفاسها وينسب الولد لزوجها الثاني من التوصيات أوصي كل مسلم بكتابة وصيته لاسيما عندما يكون على سفر عملاً بوصية سيدنا محمد صلى الله عليه وسلم .	en_US
