Abstract:

هدف هذا البحث بعنوان " مبدأ الفصل بين السلطات فى الأنظمة السياسية دراسة تطبيقية على الدساتير السودانية المعاصرة " لمعرفة مدي فعالية مبدأ الفصل بين السلطات، ومعرفة موقف الفقه السودانى من مبدأ الفصل بين السلطات وتطبيقاته القضائية من خلال أحكام القضاء الدستوري، وتكمن أهمية البحث فى أنه يكشف بساطة وسهولة التطبيق السليم لهذا المبدأ حسب الاصول السياسية مما يؤدي الى احترام كل سلطة وعدم تداخل السلطات من خلال الرقابة التي تقوم بها كل سلطة على الاخري ، وتتلخص إشكالية البحث فى معرفة الدور الذى يمكن أن يقوم به مبدأ الفصل بين السلطات حتي لا تنعدم الحرية السياسية وتسير مصالح الدولة سيرا حسنا وتصان الحريات الفردية وتحول دون استبداد الحكام، ولتحقيق ذلك إتبع الباحث المنهج التأريخي مع المنهج التحليلي والمنهج الوصفي الاستقرائي المقارن، من اهم النتائج التى توصلت اليها: لا تتحق سيادة حكم القانون الا بتقيد سلطات الدولة الثلاث بحدود ما هو مرسوم لها دستورياً، والفصل المقصود بين السلطات في النظام الديمقراطي هو الفصل المتوازن في توزيع الصلاحيات والمسؤوليات مع قيام قدر من التعاون فيما بينها لتنفيذ وظائفها في توافق وانسجام ويحد من هيمنة أي منها، ومن توصيات البحث أن يعمل المشرع السودانى إستصحاب المبادئ والأحكام التى نشأ عليها النظام السياسي الإسلامي خاصة ونحن فى مرحلة بناء نظام سياسي جديد، ومراعاة الأسس والمبادي التى نشأ عليها مبدأ الفصل بين السلطات عند تنظيم العلاقة بين السلطات فى التشريعات المستقبلية بعد تأكييد موائمتها لأحكام السياسة الشرعية الإسلامية.

It reveals the simplicity and ease of the proper application of this principle according to political principles, which leads to respect for each authority and the non-interference of the authorities through the control exercised by each authority on the other, and the problem of research is to know the role that can be done by the principle of separation of powers so as not to cease The researcher followed the method of the historical approach with the analytical method and comparative descriptive method of comparison. And the intentional separation between the authorities in the democratic system is the balanced separation of the distribution of powers and responsibilities with a measure of cooperation among them to implement their functions in harmony and harmony and limit the dominance of any one of them. The recommendations of the research that the Sudanese legislator Est Especially as we are in the process of building a new political system and taking into consideration the principles and principles that have led to the principle of separation of powers when regulating the relationship between the authorities in future legislation after confirming their compatibility with the provisions of the Islamic Shariah policy.
