dc.description	This study comes under the title of legal protection of the trade name and commercial place and means the trade name is the name used by the merchant to practice his business and distinguish his business from the rest of their counterparts. The first chapter deals with the legal provisions related to the trade name. The second chapter deals with the registration of the trade name and the legal protection of the trade name. , While the third chapter dealt with the commercial business. The study reached several results, the most important of which are, The commercial name is considered an important element of the commercial shop. The unfair competition in the case of abuse of one of them in ways that affect honesty, integrity and exploitation, To study a number of recommendations including, status of competition and illegal use in order to avoid any negative impact economically and socially clear controls.	en_US
dc.description.abstract	جاءت هذه الدراسة بعنوان الحماية القانونية للإسم التجاري والمحل التجاري بهدف بيان مفهوم الاسم والمحل التجاري وكيفية تسجيل الأسماء التجارية والآثار المترتبة عليها، وتمثلت مشكلة البحث فى الاجابة على التساؤل التالى: ماهو دور القانون فى حماية الاسم والمحل التجاري؟، وللإجابة على هذا التساؤل أتبعت في المنهج التاريخي الوثائقي والمنهج الوصفي التحليلي، وقد اشتملت الدراسة على مقدمة وثلاثة فصول، فتحدث الفصل الأول عن الأحكام القانونية المتعلقة بالاسم التجاري، وفي الفصل الثاني تحدثت عن تسجيل الاسم التجاري والحماية القانونية له، بينما تطرقت في الفصل الثالث على المحل التجاري، توصلت الدراسة إلى عدة نتائج أهمها الاسم التجاري يعتبر من العناصر المهمة للمحل التجاري، وأن المنافسة غير المشروعة تمس الأمانة والنزاهة والإستغلال، أوصت الدراسة بعدد من التوصيات من أهمها وضع ضوابط واضحة خاصة بالمنافسة والإستعمال غير المشروع تجنباً لأي تأثيرات سلبية اقتصادياً وإجتماعياً .	en_US
