dc.description	This research is entitled the provisions of imprisonment and release of security in the Code of Criminal Procedure, to show the depth of the Sudanese legislation, and the jurisprudence of Sudanese law scholars and judges in the field of imprisonment of the accused and the maintenance of his rights and with the aim of introducing detention and release of security and prejudice to the human right to freedom Discussing the issues of imprisonment and release by security is one of the thorny issues that arouse controversy between human rights judges and lawyers for violating human rights. In line with this importance, this issue is addressed through a fundamental problem of the efficiency of the legislator. The balance between the powers granted to the judicial authorities and the restrictions imposed on them to protect the rights and freedoms and the establishment of the principles of justice, the research focuses on answering the following key question: The research came from three chapters, the first of which is the detention, its procedures, its importance, justifications, legitimacy and its types, and the second chapter, what is the release of the guarantee, its importance, conditions, breaches and cases. For the three types of release, abolition, amendment and release in special cases and some practical applications in matters of release, the release of the detainee before the trial plays a vital role in the implementation of international standards in the area of pretrial detention, and his recommendations should be considered international conventions on the issue of human rights guarantees International covenants are part of domestic law and it is inadmissible under any circumstances to oppose these principles and to adhere to them and apply them in practice	en_US
dc.description.abstract	جاء هذا البحث بعنوان أحكام الحبس والإفراج بالضمان فى قانون الإجراءات الجنائية، لإظهار عمق التشريع السودانى، وإجتهادات فقهاء القانون السودانى وقضاته فى مجال حبس المتهم وصيانة حقوقه وبهدف التعريف بالحبس والإفراج بالضمان ومساس الحبس بحق الانسان فى الحرية، وبيان مفهوم الافراج بالضمان وقيوده القانونية، وتظهر أهمية البحث فى تناوله مسائل الحبس والإفراج بالضمان من المسائل الشائكة التى تثير جدلاً بين الحقوقين قضاة ومحامين لمساسها بحقوق الانسان، وتماشياً مع تلك الأهمية فإن معالجة هذا الموضوع تتم من خلال إشكالية أساسية تتمثل في مدى كفاءة المشرع في الموازنة بين ما منحه للسلطات العدلية من سلطات وبين ما أضفى عليها من قيود ضوابط حامية للحقوق والحريات وتكريس مبادئ العدالة ، فيهتم البحث بالاجابة على السؤال الرئيسي التالي: إلى أى مدي اهتم المشرع السودانى بحقوق المتهم المقبوض وشرع من الأحكام مافيه صيانة لحريته وعدم المساس بها الا لضرورة مشروعة، وقد اتبعت المنهج التأريخى الإستقرائي والمنهج الوصفي التحليلي لحل مشكلة البحث، وجاء البحث من ثلاثة فصول الأول ماهية الحبس وإجراءاته وأهميته ومبرراته ومشروعيته وانواعه، والفصل الثانى ماهية الإفراج بالضمان وأهميته وشروطه والإخلال به وحالاته ، الفصل الثالث أنواع الإفراج بالضمان وإلغاءه وتعديله والإفراج فى حالات خاصة وبعض التطبيقات العملية فى مسائل الإفراج بالضمان، من نتائج البحث يؤدي الإفراج عن المحتجز قبل المحاكمة دوراً حيوياً في إنفاذ المعايير الدولية في مجال الاحتجاز السابق للمحاكمة، ومن توصياته ضرورة اعتبار المواثيق الدولية في مسألة ضمانات حقوق الانسان والعهود الدولية جزءاً من القانون الداخلي وعدم جواز تشريع ما يعارض هذه المباديء تحت أي ظرف وجواز التمسك بها وتطبيقها فعلاً .	en_US
